Presented through three lenses, it covers the attorney's perspective on engagement letters, defining the client and scope, conflicts of interest, confidentiality in multi-party  representations, and the risks of crossing state lines; the accountant's perspective on AICPA standards, IRS Circular 230, information sharing and IRC Sec. 7216 consent, safeguarding client data, and the limits of the Sec. 7525 tax practitioner privilege versus the broader attorney-client privilege (including Kovel arrangements); and the fiduciary's perspective on the attorney-client privilege, the role of agents and facilitaros, and the fiduciary exception that can give trust beneficiaries access to otherwise privileged communications. \n \nAttendees will learn\n How to define the client and define the scope of an engagement across disciplines, and why a well-drafted engagement letter is the single most important tool for clarifying roles, managing conflicts, and reducing malpractice exposure. How the attorney-client privilege, the narrower IRS Sec. 7525 tax practitioner privilege, and Kovel arrangements actually work in practice - and the common missteps, like an inadvertent email forward or dual purpose CPA work, that waive privilege and expose clients. How to navigate the ethical duties that govern cross-disciplinary collaboration - confidentiality, informed consent, conflicts of interest, and data security - so that attorneys, accountants, and fiduciaries can share information and coordinate advice without running afoul of their respective professional standards.  \nAbout our Presenters\n \n\n \nLauren J. Wolven - ArentFox Schiff LLP, Chicago\n Lauren Wolven concentrates her practice on estate planning, tax and succession planning for privately held businesses, and trust and estate administration and litigation, and works extensively with foundations and other charitable organizations. She is a Fellow of the American College of Trust and Estate Counsel (ACTEC), where she serves as a Regent and is the former Illinois State Chair, and she teaches an LL.M. course as an adjunct professor at the University of Miami School of Law. Recognized in Best Lawyers, Illinois Super Lawyers, and the Chambers High Net Worth Guide, Lauren is a past president of the Chicago Estate Planning Council and sits on the Advisory Board for the Heckerling Institute. \n \n \n \n \n \n \n \n\n \nPaige Goepfert - Andersen, Chicago\n Paige Goepfert is a Managing Director and Client Group Lead for Andersen's Private Client Services practice, with more than 20 years of experience advising ultra-high-net-worth families, family offices, business owners, and executives on tax planning and compliance. She focuses on familly office structuring, multi-generational wealth transfer planning, and related fiduciary, gifting, and chartiable matters, and she frequently lectures on estate planning and the taxation of trusts, including for the AICPA  Advanced Estate Planning Conference and the Heckerling Institute on Estate Planning. Paige holds a BS in Accounting and a MAcc in Taxation from Brigham Young University. She is a Certified Specialist in Estate Planning, past chair of the Illinois CPA Society's Taxation, Estate, Gift and Trust Committee, past president of the Chicago Estate Planning Council's Executive Committee, and a member of the Advisory Board of the Ultra High Net Worth Institute. \n  \n \n\n \nBenetta Y. Park - Bessemer Trust, West Palm Beach\n Benetta Park is a Manaing Director and Senior Fiduciary Counsel at Bessemer Trust, where she helps clients develop multi-generational wealth transfer and tax planning strategies and guides the firm on fiduciary issues. A national resource on family office structuring, family governance, trust design, and international estate planning, she previously served as president of a single-family office and was a partner in the Private Client Department of McDermott Will & Emery.  Benetta is a Fellow of ACTEC, serving on its Board of Regents and the ACTEC Foundation Board of Directors, and currently chairs the ABA's Section of Real Property, Trust and Estate Law. A frequent speaker and writer, she has served as faculty for Heckerling and the Notre Dame Tax & Estate Planning Institute and formerly taught international estate planning at Northwestern's LLM Program.
